Healthcare Operations – Using years of experience providing counsel to large regional healthcare systems, we are able to serve as a strategic partner with management to analyze legal challenges and provide guidance in connection with the development and expansion of healthcare operations and business planning; provide guidance to ensure compliance with complex, ever-changing healthcare laws and regulations including Medicare and Medicaid Conditions of Participation; and draft and negotiate contracts including academic affiliation agreements, vendor contracts, joint venture agreements, master service agreements and professional service agreements.

Fraud and Abuse – provide counsel on how to navigate federal and state fraud and abuse laws including False Claims Act, physician self-referral laws, anti-kickback statutes, and Civil Monetary Penalties Law.

HIPAA/Privacy and Security – provide guidance as to federal and state privacy law requirements to ensure proper disclosure and protection of Protected Health Information (e.g., patient consents).

Investigations and Enforcement – assist with managing internal and external investigations of reportable incidents (e.g., improper billing, abuse and neglect, patient abandonment, physician disciplinary matters).

Medical Staff – provide guidance on medical staff governance matters including credentialing, peer review, disciplinary actions and reporting.

Regulatory – analyze and provide counsel on state and federal regulations including EMTALA, telemedicine, grievances, end of life decision-making, termination of life support, patient quality and safety, and scope of practice issues.

Policies – draft and review policies and practices governing clinical, administrative and governance matters to ensure compliance with all laws, regulations and regulatory requirements.

Compliance and Risk Management – provide guidance as to the effectiveness of compliance programs and assist with improvements to such programs based on best practices and latest HHS-OIG guidance; provide counsel on all aspects of Risk Management including internal investigations, claims management, strategies for detecting and mitigating risks, and techniques for implementing Enterprise Risk Management.
